The Divorce Process for Parents

Though each divorce is unique, there are some typical procedures the divorce process involves for parents. These include the following:

  • Parties have to attend a Children First program
  • Parties then submit custody or visitation disputes to mediation before a hearing
  • A court issues a pretrial scheduling order
  • Split hearings take place: The first hearing involves the grounds for divorce; the second hearing involves any remaining issues (child support, child custody, visitation, property distribution and debt allocation)

Property Division

Property distribution can be a major source of contention in a divorce. The more property involved, the more complicated property division can become. Because property is not necessarily divided equally, you should have an experienced attorney representing you in order to help ensure a full, fair division of the marital assets and debts.
